Terms of Service
These Terms of Service ("Terms") govern your use of PouchQuit (the "App"). By using the App, you agree to these Terms. If you do not agree, do not use the App.
1. What PouchQuit Does
PouchQuit helps users track nicotine pouch use, cravings, spending, savings estimates, and progress toward a quit or reduction plan. The App may provide reminders, motivational messages, breathing exercises, rescue prompts, progress charts, and plan estimates.
Results are not guaranteed. Quitting or reducing nicotine can be difficult, and the App cannot promise that you will quit, reduce use, avoid cravings, save a specific amount of money, or avoid relapse.
2. Not Medical Advice
You are responsible for your own health decisions. Always consult a qualified healthcare professional before making health decisions, especially if you:
- Have a medical condition, mental health condition, pregnancy, or history of substance dependence.
- Use medication, nicotine replacement therapy, or other cessation products.
- Experience severe withdrawal, anxiety, depression, chest pain, trouble breathing, or any urgent symptoms.
If you think you may have a medical emergency, call emergency services immediately.
3. Eligibility
You may use PouchQuit only if you are legally allowed to use nicotine-related cessation or reduction tools in your location and are old enough to consent to these Terms. The App is not intended for children under 13.
4. Your Responsibilities
You agree to use the App lawfully and responsibly. You are responsible for the accuracy of information you enter and for decisions you make based on that information.
You agree not to misuse the App, attempt to reverse engineer it except as allowed by law, interfere with its operation, or use it to harm yourself or others.
5. No Tobacco or Nicotine Sales
PouchQuit does not sell nicotine, tobacco, medication, or medical services. The App is intended to support tracking and reduction or quitting goals.
6. Local Data and Device Settings
The current version of the App stores quit-plan information locally on your device. You are responsible for maintaining access to your device and backups. Deleting the App may delete local App data from that device.
Some features, such as reminders, require device permissions. You can manage permissions in iOS Settings.
7. App Store and Third-Party Services
Your download and use of the App through the Apple App Store may also be governed by Apple's terms and policies. Apple controls App Store downloads, reviews, and system review prompts.
8. Intellectual Property
PouchQuit, including its design, text, graphics, branding, and software, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not transfer ownership of the App to you.
9. Changes to the App
We may update, modify, suspend, or discontinue any part of the App at any time. Features may change as we improve the product.
10. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or that any plan, reminder, estimate, rescue flow, or suggestion will meet your needs.
11. Limitation of Liability
To the fullest extent allowed by law, PouchQuit and its owners, operators, affiliates, and contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, health outcomes, relapse, or personal decisions made while using the App.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
12. Indemnity
You agree to indemnify and hold harmless PouchQuit and its owners, operators, affiliates, and contributors from claims, damages, losses, liabilities, and expenses arising from your misuse of the App, violation of these Terms, or violation of law.
13. Termination
You may stop using the App at any time. We may restrict or terminate access to the App if we believe you violated these Terms or if continued access creates risk.
14. Updates to These Terms
We may update these Terms from time to time. The updated version will be posted with a new effective date. Continued use of the App after updates means you accept the revised Terms.
